These Terms of Use ("Terms") govern your use of the Protecting Our Students, Inc. ("we," "us," "our") website and related services. By accessing or using our site or services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our site.
1. Mission and Purpose
Protecting Our Students, Inc. is a nonprofit organization dedicated to eliminating school shootings and improving safety in K–12 schools nationwide. All services, resources, and programs provided through our website support this mission.
2. Eligibility
Our website is intended for individuals aged 18 or older. By using the site, you confirm you meet this requirement.
3. Donations
- All donations are voluntary and tax-deductible to the extent allowed by law.
- Donations are processed through secure third-party payment processors such as Stripe.
- No Refund Policy: All donations are final. Because donations are immediately allocated to mission-related programs and may be tax-deductible, we do not offer refunds, in whole or in part, for any reason.
- Donors are responsible for ensuring that donation amounts and payment information are correct before submitting.
4. Assessment Services and Safety Scores
This section applies to schools and districts using POSI's assessment frameworks, including the 4-Level Safety Standard℠, the 94-Point Safety Zones℠, the Dynamic Safety Score℠, and the SafeSchool REPORT℠ (collectively, the "Assessment Services").
A. Self-assessment model.
The Assessment Services are school-administered self-assessments. Scores, findings, and reports are generated from information provided by the school's own personnel. POSI does not independently inspect, verify, or audit a school's facilities or practices unless separately agreed in writing.
B. Authorized use.
By initiating an assessment on behalf of a school or district, you represent that you are authorized to do so by that institution's leadership.
C. Accuracy of inputs.
The quality of assessment outputs depends on the accuracy and completeness of the information your team provides. Schools are responsible for the truthfulness of their responses.
D. No guarantee of safety.
A Dynamic Safety Score℠, SafeSchool REPORT℠, or any other assessment output is a measurement and planning tool — not a guarantee, warranty, or prediction of safety. No score, however high, ensures that a safety incident will not occur. The Assessment Services do not replace professional security consulting, law enforcement guidance, engineering or code inspections, legal advice, or a school's own judgment and emergency planning.
E. Data ownership and confidentiality.
School Assessment Data is owned by the school and governed by Section 4 of our Privacy Policy — private by default, published only with the school's written authorization.
F. Service availability.
Assessment platforms may be updated, suspended, or modified as we improve the frameworks. Material changes affecting active assessments will be communicated to participating schools.
5. Intellectual Property
Unless otherwise noted, all content on our website — including text, images, graphics, logos, and program materials — is owned by Protecting Our Students, Inc. The 4-Level Safety Standard℠, 94-Point Safety Zones℠, Dynamic Safety Score℠, SafeSchool REPORT℠, SITE|SAFETYNET℠, and SafeSchoolMAP℠ marks and frameworks are proprietary intellectual property of Protecting Our Students, Inc.
- You may view, download, and print content for personal, non-commercial use.
- You may not modify, distribute, reproduce, or use our content, frameworks, or marks for commercial purposes without our written permission.
6. User Conduct
You agree not to:
- Use our site or services for any unlawful purpose
- Attempt to gain unauthorized access to our systems or to another school's assessment data
- Upload or transmit harmful code or content
- Misrepresent your affiliation with a school or district
7. Third-Party Links
Our website may link to third-party sites. We are not responsible for their content, policies, or practices.
8. Disclaimer of Warranties
Our website and services are provided "as is" and "as available," without warranties of any kind. We make no guarantees regarding the accuracy, completeness, or availability of content or services.
9. Limitation of Liability
To the maximum extent permitted by law, Protecting Our Students, Inc. shall not be liable for any damages arising from your use of the site or services, reliance on any content, or reliance on any assessment output, score, or report.
10. Indemnification
You agree to indemnify and hold harmless Protecting Our Students, Inc., its officers, employees, and volunteers from any claims, damages, or expenses related to your use of the site or services or violation of these Terms.
11. Changes to Terms
We reserve the right to update these Terms from time to time. Changes will be posted on this page with the updated effective date. Continued use of the site after changes constitutes your acceptance of the updated Terms.
